Overview

Simon is a partner in our Nassau office, primarily focused on real estate transactional work and resort development. He has acted for several of the largest residential and resort developers in the jurisdiction, as well as numerous private clients. In particular, he has acted for non-Bahamian second homeowners purchasing real estate in the gated communities of Nassau and Paradise Island, along with the private islands and cays and other real estate throughout the family islands of The Bahamas.

He has a wealth of experience guiding foreign investors through the regulatory processes and governmental approvals involved in purchasing real estate and establishing businesses and residency in The Bahamas. He has also negotiated and drafted heads of agreement with the Bahamian government for concessions for hotel and mixed-use resort developments.

Simon has been involved in putting together sales programs and conducting master planning for several condominium developers in Nassau and Paradise Island, including preparing governing documents and assisting with the representation of developers from the planning phase to closing of sales. He has also been involved in representing numerous local and non-Bahamian financial institutions and lenders in the financing of residential, commercial and resort developments and acquisitions, and has advised lenders on power of sale and foreclosure proceedings following borrower insolvencies.

In addition, Simon can assist with obtaining title insurance for real estate purchasers and lenders in The Bahamas, and with the formation of companies to act as vehicles for holding assets and making investments.

  • Representing Aristo Development Limited, one of The Bahamas’ largest residential developers in the master planning and sales of condominium units at the One Cable Beach and Balmoral condominium developments in Nassau.
  • Representing numerous high net worth individuals in the purchase and sale of real estate in Ocean Club, Lyford Cay, Harbour Island, Hope Town Abaco and other high-end communities throughout The Bahamas.
  • Representing Behringer Harvard, a Texas-based hedge fund in the sale of the 431-acre cay known as Royal Island in Eleuthera under mortgagee power of sale.
